Home Insurance Legislation in Morocco
The legal framework of home insurance in Morocco is defined by the Insurance Code (law 17-99). Knowing your rights and obligations is essential.
The Insurance Code (Law 17-99)
Law 17-99 establishing the Insurance Code is the founding text governing all insurance operations in Morocco. It defines the rights and obligations of policyholders and insurers.
Policyholder obligations
- Accurately declare the risk at subscription
- Pay the premium at agreed deadlines
- Declare any claim within 5 working days (2 days for theft)
- Inform the insurer of any change of situation
Policyholder rights
- Right to pre-contractual information
- Right to annual cancellation (with notice)
- Right to indemnification within contractual deadlines
- Right of contestation with ACAPS (supervisory authority)
Role of ACAPS
The Insurance and Social Welfare Supervisory Authority (ACAPS) is the regulatory body for the insurance sector in Morocco. It oversees regulatory compliance, protects policyholders' rights, and can be referred to free of charge in case of disputes with your insurer.
After the Al Haouz earthquake (2023)
The September 2023 earthquake revealed that less than 5% of Moroccan households had home insurance. Since then, authorities have been working on a natural disaster compensation scheme. It is strongly recommended to verify that your contract includes natural disaster coverage, or subscribe to it as an option.
